   4 THE SOFTWARE.  BY USING THE SOFTWARE, YOU ARE AGREEING TO BE
   5 BOUND BY THE TERMS OF THIS LICENSE.  IF YOU DO NOT AGREE TO THE
   6 TERMS OF THIS LICENSE, DO NOT INSTALL OR USE THE SOFTWARE,
   7 DELETE THE SOFTWARE AND ALL RELATED FILES FROM YOUR COMPUTER,
   8 AND PROMPTLY RETURN THIS PACKAGE AND ITS CONTENTS TO THE PLACE
   9 OF PURCHASE FOR REFUND OF THE AMOUNT YOU PAID.

  11 The software, artwork, music, and other components included in
  12 this computer program (the "Software") are the copyrighted
  13 property of LucasArts Entertainment Company LLC and its
  14 licensors (collectively referred to as "LEC"). The Software is
  15 licensed (not sold) to you, and LEC owns all copyright, trade
  16 secret, patent and other proprietary rights in the Software.
  17 You may use the Software on a single computer. You may not:
  18 (1) copy (other than once for back-up purposes), distribute,
  19 rent, lease or sublicense all or any portion of the Software;
  20 (2) modify or prepare derivative works of the Software;
  21 (3) transmit the Software over a network, by telephone, or
  22 electronically using any means, except in the course of your
  23 network multi-player play of the Software; or (4) reverse
  24 engineer, decompile or disassemble the Software. You may
  25 transfer the Software, but only if the recipient agrees to
  26 accept the terms and conditions of this Agreement.  If you
  27 transfer the Software, you must transfer all components and
  28 documentation and erase any copies residing on computer equip-
  29 ment. Your license is automatically terminated if you transfer
  30 the Software.

  32 LEC warrants to the original consumer purchaser that the media
  33 furnished in this product will be free from defects in
  34 materials and workmanship under normal use for a period of
  35 ninety (90) days from the date of purchase (as evidenced by
  36 your receipt). If the media supplied as part of this product
  37 proves to be defective, and provided that the consumer
  38 purchaser returns the media to LEC in accordance with the
  39 instructions in this paragraph, LEC will replace the defective
  40 media: (a) free of charge to the consumer purchaser, if the
  41 media proves to be defective within the ninety (90) day period
  42 following the date of purchase, and (b) if the media proves to
  43 be defective after the expiration of the ninety (90) day
  44 warranty period, LEC will replace the defective media for a fee
  45 of $5.00 per Compact Disc.  To obtain a replacement CD, please
  46 return the CD only, postage prepaid, to LEC, at the address
  47 below, accompanied by proof of date of purchase, a description
  48 of the defect, and your name and return address. To replace
  49 defective media after expiration of the warranty period, send
  50 the CD only, postage prepaid, to LEC at the address below,
  51 enclosing proof of purchase, a description of the defect, your
  52 name and return address, and a check for $5.00 per Compact
  53 Disc. LEC will mail a replacement to you.

  55 You expressly acknowledge and agree that use of the Software is
  56  at your sole risk.  Except for the limited ninety (90) day
  57 warranty on the media set forth above, the Software and any
  58 related documentation or materials are provided "AS IS" and
  59 without warranty of any kind.  LEC EXPRESSLY DISCLAIMS ALL
  60 WARRANTIES, EXPRESS AND IMPLIED, INCLUDING, BUT NOT LIMITED TO,
  61 THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A
  62 PARTICULAR PURPOSE AND NONINFRINGEMENT.  LEC DOES NOT WARRANT
  63 THAT THE FUNCTIONS CONTAINED IN THE SOFTWARE WILL MEET YOUR
  64 REQUIREMENTS, OR THAT THE OPERATION OF THE SOFTWARE WILL BE
  65 UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS IN THE SOFTWARE
  66 WILL BE CORRECTED.  THE ENTIRE RISK AS TO THE RESULTS AND
  67 PERFORMANCE OF THE SOFTWARE IS ASSUMED BY YOU.  SOME
  68 JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES,
  69 SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.

  71 UNDER NO CIRCUMSTANCES INCLUDING NEGLIGENCE SHALL LEC, OR ITS
  72 DIRECTORS, OFFICERS, EMPLOYEES OR AGENTS, BE LIABLE TO YOU FOR
  73 ANY INCIDENTAL, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES
  74 (INCLUDING DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS
  75 INTERRUPTION, LOSS OF BUSINESS INFORMATION, AND THE LIKE)
  76 ARISING OUT OF THE POSSESSION, USE, OR MALFUNCTION OF THIS
  77 PRODUCT, INCLUDING WITHOUT LIMITATION, DAMAGE TO PROPERTY AND,
  78 TO THE EXTENT PERMITTED BY LAW, DAMAGES FOR PERSONAL INJURY,
  79 EVEN IF LEC HAS BEEN ADVISED OF THE POSSIBILITY OF ANY SUCH
  80 DAMAGES OR LOSS, AND EVEN IF LEC OR AN LEC AUTHORIZED
  81 REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH
  82 DAMAGES.  SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR
  83 EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES,
  84 SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

  86 THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE
  87 OTHER RIGHTS DEPENDING ON THE LAWS IN YOUR STATE. YOU AGREE
  88 THAT THE LIABILITY OF LEC ARISING OUT OF ANY KIND OF LEGAL
  89 CLAIM (WHETHER IN CONTRACT, TORT, OR OTHERWISE) WILL NOT EXCEED
  90 THE AMOUNT YOU ORIGINALLY PAID FOR THE USE OF THIS PRODUCT.
