   1 End User License Agreement
   2 YOU SHOULD CAREFULLY READ THE FOLLOWING END USER LICENSE AGREEMENT
   3 BEFORE INSTALLING THIS SOFTWARE PROGRAM. BY INSTALLING OR OTHERWISE
   4 USING THE SOFTWARE PROGRAM, YOU AGREE TO BE BOUND BY THE TERMS OF THIS
   5 AGREEMENT.

   7 This software program (the "Program"), any printed materials, any
   8 on-line or electronic documentation (the "Manuals"), and any and all
   9 copies and derivative works of such software program are the
  10 copyrighted work of Linux Game Publishing LTD and its licensors. All
  11 rights reserved, except as expressly stated herein. All use of the
  12 Program is governed by the terms of this End User License Agreement
  13 ("License Agreement"). The Program is solely for use by end users
  14 according to the terms of the Licence Agreement. Any use, reproduction
  15 or redistribution of the Program not in accordance with the terms of
  16 the Licence Agreement is expressly prohibited.

  18 1. Limited Use License. Linux Game Publishing ("LGP") hereby grants,
  19 and by installing the Program you thereby accept, a limited,
  20 non-exclusive license and right to install and use one (1) copy of the
  21 Program for your use on either a home, business, or portable
  22 computer. The Program is licensed not sold. Your license confers no
  23 title or ownership in the Program.

  25 2. Ownership. All title, ownership rights and intellectual property
  26 rights in and to the Program and any and all copies thereof (including
  27 but not limited to any titles, computer code, themes, objects,
  28 characters, character names, stories, dialog, catch phrases,
  29 locations, concepts, artwork, animations, sounds, musical
  30 compositions, audio-visual effects, methods of operation, moral
  31 rights, and any related documentation, and "applets" incorporated into
  32 the Program) are owned by LGP and its licensors. The Program is
  33 protected by the copyright laws of the United Kingdom, international
  34 copyright treaties and conventions and other laws. All rights are
  35 reserved. The Program contains certain licensed materials and LGP's
  36 licensors may protect their rights in the event of any violation of
  37 this Agreement.

  39 3. Responsibilities of End User.
  40 A. Subject to the Grant of License hereinabove, you may not, in whole
  41 or in part, copy, photocopy, reproduce, translate, reverse engineer,
  42 derive source code, modify, disassemble, decompile, create derivative
  43 works based on the Program, or remove any proprietary notices or
  44 labels on the Program without the prior written consent of LGP.
  45 B. The Program is licensed to you as a single product. Its component
  46 parts may not be separated for use on more than one computer.
  47 C. You are entitled to use the Program for your own use, but you are
  48 not entitled to: (i) sell, grant a security interest in or transfer
  49 reproductions of the Program to other parties in any way, nor to rent,
  50 lease or license the Program to others without the prior written
  51 consent of LGP; or (ii) exploit the Program or any of its parts for
  52 any commercial purpose including, but not limited to, use at a cyber
  53 cafe, computer gaming center or any other location-based site. LGP may
  54 offer a separate Site License Agreement to permit you to make the
  55 Program available for commercial use. Contact LGP for details.

  57 4. Program Transfer. You may transfer all of your rights
  58 under this License Agreement, provided the recipient agrees to the
  59 terms of this License Agreement.

  61 5. Termination. The License Agreement is effective until
  62 terminated. You may terminate the License Agreement at any time by
  63 destroying the Program. LGP may, at its discretion, terminate this
  64 License Agreement in the event that you fail to comply with the terms
  65 and conditions contained herein. In such event, you must immediately
  66 destroy the Program.

  68 6. Export Controls. The program may not be re-exported, downloaded,
  69 otherwise exported into (or to a national or resident of) any country
  70 to whom it would be illegal to export the Program under UK law.

  72 7. Limited Warranty. Except as expressly and unambiguously set forth
  73 in this paragraph 7, LGP and its licensors disclaim any warranty for
  74 the Program, Editor and Manual(s). The Program, Editor and Manual(s)
  75 are provided "as is" without any warranty of any kind, either express
  76 or implied, including, without limitation, the implied warranties of
  77 merchantability, fitness for a particular purpose, or
  78 noninfringement. The entire risk arising out of use or performance of
  79 the Program, Editor, and Manual(s) remains with the User, however LGP
  80 warrants up to and including 90 days from the date of your purchase of
  81 the Program that the media containing the Program shall be free from
  82 defects in material and workmanship. In the event that the media
  83 proves to be defective during that time period, and upon presentation
  84 to LGP of proof of purchase of the defective Program, LGP will at its
  85 option: (i) correct any defect; (ii) provide a replacement copy of the
  86 same product; or (iii) refund your money.

  88 8. Limitation of Liability. NEITHER LGP, ITS LICENSORS NOR ANY PARENT,
  89 SUBSIDIARY OR AFFILIATE OF THE FOREGOING SHALL BE LIABLE IN ANY WAY
  90 FOR LOSS OR DAMAGE OF ANY KIND RESULTING FROM THE USE OF THE PROGRAM,
  91 EDITOR, AND MANUAL(S) INCLUDING, WITHOUT LIMITATION, LOSS OF GOODWILL,
  92 WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER
  93 COMMERCIAL DAMAGES OR LOSSES.

  95 9. Equitable Remedies. You hereby agree that LGP would be irreparably
  96 damaged if the terms of this License Agreement were not specifically
  97 enforced, and therefore you agree that LGP shall be entitled, without
  98 bond, other security, or proof of damages, to appropriate equitable
  99 remedies with respect to breaches of this License Agreement, in
 100 addition to such other remedies as LGP may otherwise have available to
 101 it under applicable laws. In the event that any litigation is brought
 102 by either party in connection with this License Agreement, the
 103 prevailing party in such litigation shall be entitled to recover from
 104 the other party all the costs, attorney's fees and other expenses
 105 incurred by such prevailing party in the litigation.

 107 10. Limitations on License. Nothing in this License Agreement shall
 108 preclude you from making or authorizing the making of copies of
 109 the Program provided, however, that all copies are complete and exact
 110 copies of the original, including this license.

 112 11. Miscellaneous. This License Agreement shall be deemed to have been
 113 made and executed in the United Kingdom and any dispute arising
 114 hereunder shall be resolved in accordance with the laws of the UK. You
 115 agree that any claim asserted in any legal proceeding by one of the
 116 parties against the other shall be commenced and maintained in the
 117 appropriate court located in Nottingham, England, having subject
 118 matter jurisdiction with respect to the dispute between the
 119 parties. This License Agreement may be amended, altered or modified
 120 only by an instrument in writing, specifying such amendment,
 121 alteration or modification, executed by both parties. In the event
 122 that any provision of this License Agreement shall be held by a court
 123 or other tribunal of competent jurisdiction shall be unenforceable,
 124 such provision will be enforced to the maximum extent permissible and
 125 the remaining portions of this License Agreement shall remain in full
 126 force and effect. This License Agreement constituted and contains the
 127 entire agreement between the parties with respect to the subject
 128 matter hereof and supersedes any prior oral or written agreements. You
 129 hereby acknowledge that you have read and understand the forgoing
 130 License Agreement and agree that the action of installing the Program
 131 is an express acknowledgment of your agreement to be bound by the
 132 terms and conditions of this License Agreement. You also acknowledge
 133 and agree that this License Agreement is the complete and exclusive
 134 statement of the agreement between you and LGP and that this License
 135 Agreement supersedes any prior or contemporaneous agreement, either
 136 oral or written, and any other communications between you and LGP.
