   5 The MITRE Corporation (MITRE) licenses the Egress Filtering Diagnosis
   6 Tool to you without charge .  As used in this License, the Term
   7 "Egress Filtering Information Tool" includes any documentation and
   8 test results provided.

  10 The Egress Filtering Diagnosis Tool is the copyright work and the
  11 proprietary intellectual property of MITRE.  No ownership or other
  12 proprietary interest in the Egress Filtering Diagnosis Tool is
  13 granted you other than what is granted in this license. You may not
  14 sell the Egress Filtering Diagnosis Tool to a third party, or charge
  15 for using it to provide services to a third party

  17 YOU ASSUME ALL RISK AS TO THE SELECTION, USE, PERFORMANCE AND QUALITY
  18 OF THE EGRESS FILTERING DIAGNOSIS TOOL.  MITRE IS PROVID-ING THE
  19 EGRESS FILTERING DIAGNOSIS TOOL "AS IS" AND MAKES NO WA-RRANTY,
  20 EXPRESS OR IMPLIED, AS TO THE ACCURACY, CAPABILITY, EFFI-CIENCY,
  21 MERCHANTABILITY, OR FUNCTIONING OF THE EGRESS FILTERING DIAGNOSIS
  22 TOOL.  IN NO EVENT WILL MITRE BE LIABLE FOR ANY GENERAL,
  23 CONSEQUENTIAL,  INDIRECT, INCIDENTAL, EXEMPLARY OR SPECIAL DAMAGES,
  24 REGARDLESS OF THE CAUSE THEREOF, EVEN IF MITRE HAS BEEN ADVISED OF THE
  25 POSSIBILITY OF SUCH DAMAGES.

  27 You accept the Egress Filtering Diagnosis Tool on the condition that
  28 you indemnify and hold harmless MITRE, its Board of Trustees,
  29 officers, agents, and employees, from any and all liability or damages
  30 to third parties, including attorneys' fees, court costs, and other
  31 related costs and expenses, arising out of your use of the Egress
  32 Filtering Diagnosis Tool irrespective of the cause of said liability.

  34 You remain solely responsible for the security of your systems and for
  35 the consequences of the use of the Egress Filtering Diagnosis Tool.
  36 You assume the entire risk of any servicing, repair, or correction of
  37 your property or operations arising out of your use of the Egress
  38 Filtering Diagnosis Tool.

  40 MITRE uses its best efforts to protect against the loss, misuse or
  41 alteration of information and information systems under its control by
  42 incorporating security systems.  However, if any MITRE server or
  43 information system is penetrated or otherwise compromised, MITRE shall
  44 have no liability to you or anyone claiming through you for any damage
  45 or injury caused by the intentional, unintentional or negligent acts
  46 of third parties.

  48 The export from the United States or the subsequent reexport of the
  49 Egress Filtering Diagnosis Tool is subject to compliance with United
  50 States export control and munitions control restrictions. You agree
  51 that in the event you seek to export the Egress Filtering Diagnosis
  52 Tool you assume full responsibility for obtaining all necessary export
  53 licenses and approvals and for assuring compliance with applicable
  54 reexport restrictions.

  56 If any provision of these terms is deemed unlawful, void, or for any
  57 reason unenforceable, then that provision will be deemed severable
  58 from these terms and will not affect the validity and enforceability
  59 of the remaining provisions.

  61 This License shall be governed by the laws of the Commonwealth of
  62 Virginia without regard to Virginia conflicts of laws rules.  Any
  63 legal action concerning use of the Egress Filtering Diagnosis Tool or
  64 this License must be filed in the U.S. District Court for the Eastern
  65 District of Virginia.
