   4 CAREFULLY BEFORE CONTINUING WITH THIS PROGRAM INSTALL

   6 3909 LLC's End-User License Agreement ("EULA") is a legal agreement between
   7 you (either an individual or a single entity) and 3909 LLC for the 3909 LLC
   8 software product(s) identified above which may include associated software
   9 components, media, printed materials, and "online" or electronic documentation
  10 ("SOFTWARE PRODUCT"). By installing, copying, or otherwise using the SOFTWARE
  11 PRODUCT, you agree to be bound by the terms of this EULA. This license
  12 agreement represents the entire agreement concerning the program between you
  13 and 3909 LLC, (referred to as "licenser"), and it supersedes any prior
  14 proposal, representation, or understanding between the parties. If you do
  15 not agree to the terms of this EULA, do not install or use the SOFTWARE
  16 PRODUCT.

  18 The SOFTWARE PRODUCT is protected by copyright laws and international
  19 copyright treaties, as well as other intellectual property laws and treaties.
  20 The SOFTWARE PRODUCT is licensed, not sold.

  22 1. GRANT OF LICENSE.
  23 The SOFTWARE PRODUCT is licensed as follows:
  24 (a) Installation and Use.
  25 3909 LLC grants you the right to install and use copies of the SOFTWARE
  26 PRODUCT on your computer running a validly licensed copy of the operating
  27 system for which the SOFTWARE PRODUCT was designed.
  28 (b) Backup Copies.
  29 You may also make copies of the SOFTWARE PRODUCT as may be necessary for
  30 backup and archival purposes.

  32 2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.
  33 (a) Maintenance of Copyright Notices.
  34 You must not remove or alter any copyright notices on any and all copies
  35 of the SOFTWARE PRODUCT.
  36 (b) Distribution.
  37 You may not distribute registered copies of the SOFTWARE PRODUCT to third
  38 parties. Evaluation versions available for download from 3909 LLC's websites
  39 may be freely distributed.
  40 (c) Prohibition on Reverse Engineering, Decompilation, and Disassembly.
  41 You may not reverse engineer, decompile, or disassemble the SOFTWARE PRODUCT,
  42 except and only to the extent that such activity is expressly permitted by
  43 applicable law notwithstanding this limitation.
  44 (d) Rental.
  45 You may not rent, lease, or lend the SOFTWARE PRODUCT.
  46 (e) Support Services.
  47 3909 LLC may provide you with support services related to the SOFTWARE
  48 PRODUCT ("Support Services"). Any supplemental software code provided to you
  49 as part of the Support Services shall be considered part of the SOFTWARE
  50 PRODUCT and subject to the terms and conditions of this EULA.
  51 (f) Compliance with Applicable Laws.
  52 You must comply with all applicable laws regarding use of the SOFTWARE
  53 PRODUCT.

  55 3. TERMINATION
  56 Without prejudice to any other rights, 3909 LLC may terminate this EULA if
  57 you fail to comply with the terms and conditions of this EULA. In such event,
  58 you must destroy all copies of the SOFTWARE PRODUCT in your possession.

  60 4. COPYRIGHT
  61 All title, including but not limited to copyrights, in and to the SOFTWARE
  62 PRODUCT and any copies thereof are owned by 3909 LLC or its suppliers. All
  63 title and intellectual property rights in and to the content which may be
  64 accessed through use of the SOFTWARE PRODUCT is the property of the
  65 respective content owner and may be protected by applicable copyright or
  66 other intellectual property laws and treaties. This EULA grants you no
  67 rights to use such content. All rights not expressly granted are reserved
  68 by 3909 LLC.

  70 5. NO WARRANTIES
  71 3909 LLC expressly disclaims any warranty for the SOFTWARE PRODUCT. The
  72 SOFTWARE PRODUCT is provided 'As Is' without any express or implied warranty
  73 of any kind, including but not limited to any warranties of merchantability,
  74 non-infringement, or fitness of a particular purpose. 3909 LLC does not
  75 warrant or assume responsibility for the accuracy or completeness of any
  76 information, text, graphics, links or other items contained within the
  77 SOFTWARE PRODUCT. 3909 LLC makes no warranties respecting any harm that
  78 may be caused by the transmission of a computer virus, worm, time bomb,
  79 logic bomb, or other such computer program. 3909 LLC further expressly
  80 disclaims any warranty or representation to Authorized Users or to any
  81 third party.

  83 6. LIMITATION OF LIABILITY
  84 In no event shall 3909 LLC be liable for any damages (including, without
  85 limitation, lost profits, business interruption, or lost information) rising
  86 out of 'Authorized Users' use of or inability to use the SOFTWARE PRODUCT,
  87 even if 3909 LLC has been advised of the possibility of such damages. In no
  88 event will 3909 LLC be liable for loss of data or for indirect, special,
  89 incidental, consequential (including lost profit), or other damages based
  90 in contract, tort or otherwise. 3909 LLC shall have no liability with
  91 respect to the content of the SOFTWARE PRODUCT or any part thereof, including
  92 but not limited to errors or omissions contained therein, libel,
  93 infringements of rights of publicity, privacy, trademark rights, business
  94 interruption, personal injury, loss of privacy, moral rights or the
  95 disclosure of confidential information.
