86 4. Restrictions. The license granted in Section 3 above is expressly made
87 subject to and limited by the following restrictions:

91 You must include a copy of, or the Uniform Resource Identifier for,
92 this License with every copy or phonorecord of the Work You
93 distribute, publicly display, publicly perform, or publicly digitally

166 for the public performance or public digital performance (e.g.
167 webcast) of the Work if that performance is primarily intended
168 for or directed toward commercial advantage or private monetary
170 ii. Mechanical Rights and Statutory Royalties. Licensor reserves the
171 exclusive right to collect, whether individually or via a music
172 rights agency or designated agent (e.g. Harry Fox Agency),
173 royalties for any phonorecord You create from the Work ("cover
174 version") and distribute, subject to the compulsory license
175 created by 17 USC Section 115 of the US Copyright Act (or the
176 equivalent in other jurisdictions), if Your distribution of such
177 cover version is primarily intended for or directed toward
178 commercial advantage or private monetary compensation.
180 f. Webcasting Rights and Statutory Royalties. For the avoidance of doubt,
181 where the Work is a sound recording, Licensor reserves the exclusive
182 right to collect, whether individually or via a performance-rights
183 society (e.g. SoundExchange), royalties for the public digital
184 performance (e.g. webcast) of the Work, subject to the compulsory
185 license created by 17 USC Section 114 of the US Copyright Act (or the
186 equivalent in other jurisdictions), if Your public digital performance
187 is primarily intended for or directed toward commercial advantage or
188 private monetary compensation.
190 5. Representations, Warranties and Disclaimer
192 UNLESS OTHERWISE MUTUALLY AGREED TO BY THE PARTIES IN WRITING, LICENSOR
193 OFFERS THE WORK AS-IS AND MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY
194 KIND CONCERNING THE WORK, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE,
195 INCLUDING, WITHOUT LIMITATION, WARRANTIES OF TITLE, MERCHANTIBILITY,
196 FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT, OR THE ABSENCE OF
197 LATENT OR OTHER DEFECTS, ACCURACY, OR THE PRESENCE OF ABSENCE OF ERRORS,
198 WHETHER OR NOT DISCOVERABLE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION
199 OF IMPLIED WARRANTIES, SO SUCH EXCLUSION MAY NOT APPLY TO YOU.
201 6. Limitation on Liability. EXCEPT TO THE EXTENT REQUIRED BY APPLICABLE
202 LAW, IN NO EVENT WILL LICENSOR BE LIABLE TO YOU ON ANY LEGAL THEORY FOR
203 ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES
204 ARISING OUT OF THIS LICENSE OR THE USE OF THE WORK, EVEN IF LICENSOR HAS
205 BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
209 a. This License and the rights granted hereunder will terminate
210 automatically upon any breach by You of the terms of this License.
211 Individuals or entities who have received Derivative Works or
212 Collective Works from You under this License, however, will not have
213 their licenses terminated provided such individuals or entities remain
214 in full compliance with those licenses. Sections 1, 2, 5, 6, 7, and 8
215 will survive any termination of this License.
216 b. Subject to the above terms and conditions, the license granted here is
217 perpetual (for the duration of the applicable copyright in the Work).
218 Notwithstanding the above, Licensor reserves the right to release the
219 Work under different license terms or to stop distributing the Work at
220 any time; provided, however that any such election will not serve to
221 withdraw this License (or any other license that has been, or is
222 required to be, granted under the terms of this License), and this
223 License will continue in full force and effect unless terminated as
228 a. Each time You distribute or publicly digitally perform the Work or a
229 Collective Work, the Licensor offers to the recipient a license to the

245 e. This License constitutes the entire agreement between the parties with
246 respect to the Work licensed here. There are no understandings,
247 agreements or representations with respect to the Work not specified
248 here. Licensor shall not be bound by any additional provisions that
249 may appear in any communication from You. This License may not be
250 modified without the mutual written agreement of the Licensor and You.
253 Creative Commons is not a party to this License, and makes no warranty
254 whatsoever in connection with the Work. Creative Commons will not be
255 liable to You or any party on any legal theory for any damages
256 whatsoever, including without limitation any general, special,
257 incidental or consequential damages arising in connection to this
258 license. Notwithstanding the foregoing two (2) sentences, if Creative
259 Commons has expressly identified itself as the Licensor hereunder, it
260 shall have all rights and obligations of Licensor.
262 Except for the limited purpose of indicating to the public that the
263 Work is licensed under the CCPL, neither party will use the trademark
264 "Creative Commons" or any related trademark or logo of Creative
265 Commons without the prior written consent of Creative Commons. Any
266 permitted use will be in compliance with Creative Commons'
267 then-current trademark usage guidelines, as may be published on its
268 website or otherwise made available upon request from time to time.
