  70 BECAUSE XBATTLE IS LICENSED FREE OF CHARGE, WE PROVIDE ABSOLUTELY NO
  71 WARRANTY, TO THE EXTENT PERMITTED BY APPLICABLE STATE LAW.  THE ENTIRE
  72 RISK AS TO THE QUALITY AND PERFORMANCE OF THE PROGRAM IS WITH YOU.
  73 SHOULD THE XBATTLE PROGRAM PROVE DEFECTIVE, YOU ASSUME THE COST OF ALL
  74 NECESSARY SERVICING, REPAIR OR CORRECTION.

  76 IN NO EVENT UNLESS REQUIRED BY APPLICABLE LAW WILL STEVE LEHAR, GREG
  77 LESHER, OR ANY OTHER PARTY WHO MAY MODIFY AND REDISTRIBUTE XBATTLE AS
  78 PERMITTED ABOVE, BE LIABLE TO YOU FOR DAMAGES, INCLUDING ANY LOST PROFITS,
  79 LOST MONIES, OR OTHER SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING
  80 OUT OF THE USE OR INABILITY TO USE (INCLUDING BUT NOT LIMITED TO LOSS OF
  81 DATA OR DATA BEING RENDERED INACCURATE OR LOSSES SUSTAINED BY THIRD PARTIES
  82 OR A FAILURE OF THE PROGRAM TO OPERATE WITH PROGRAMS NOT DISTRIBUTED BY STEVE
