   4 Whereas Doug Lea desires to utlized certain Java Software technologies
   5 in the util.concurrent technology; and

   7 Whereas Sun Microsystems, Inc. (“Sun”) desires that Doug Lea utilize
   8 certain Java Software technologies in the util.concurrent technology;

  10 Therefore the parties agree as follows, effective May 31, 2002:

  12 “Java Software technologies” means
  13
  14        classes/java/util/ArrayList.java, and
  15        classes/java/util/HashMap.java.

  17 The Java Software technologies are Copyright (c) 1994-2000 Sun
  18 Microsystems, Inc. All rights reserved.

  20 Sun hereby grants Doug Lea a non-exclusive, worldwide,
  21 non-transferrable license to use, reproduce, create derivate works of,
  22 and distribute the Java Software and derivative works thereof in
  23 source and binary forms as part of a larger work, and to sublicense
  24 the right to use, reproduce and distribute the Java Software and Doug
  25 Lea's derivative works as the part of larger works through multiple
  26 tiers of sublicensees provided that the following conditions are met:

  28 -Neither the name of or trademarks of Sun may be used to endorse or
  29 promote products including or derived from the Java Software
  30 technology without specific prior written permission; and
  31 -Redistributions of source or binary code must contain the above
  32 copyright notice, this notice and and the following disclaimers:
