   6 LIMITED USE SOFTWARE LICENSE AGREEMENT

   8 This Limited Use Software License Agreement (the "Agreement") is a
   9 legal agreement between you, idevgames.com, and Joseph Humfrey. By
  10 downloading or otherwise receiving the software material, which
  11 includes source code (the "Source Code"), you are agreeing to be bound
  12 by the terms of this Agreement. If you do not agree to the terms of
  13 this Agreement, promptly destroy the Software.

  15 "Distribution" refers to all material included in the logical
  16 container of this license file (e.g. folder, directory, or archive).

  18 "Software" refers to all material in the Distribution, and any
  19 derivative thereof, that can be used to control the operation of a
  20 computer, directly or indirectly, including, but not limited to,
  21 source code, byte code, object code, executables, and scripts. This
  22 does not include any images, sounds, movies, music, models, or other
  23 content included in the Distribution.

  25 "Private use" refers to use of the Software on a personal computer
  26 owned or controlled by you.

  28 "Educational use" refers to examination and modification of the
  29 Software to better understand the techniques used in it.

  31 "Commercial Use" refers to use of the Software resulting in
  32 foreseeable compensation or use in connection with any business
  33 activity.

  35 "Use" refers to loading into memory, executing, interpreting,
  36 installing, copying, compiling, decompiling, disassembling, recording,
  37 compressing, decompressing, transferring, translating, or otherwise
  38 processing the Software.

  40 1. Grant of License.

  42 Joseph Humfrey grants to you the right to Use the Software for Private
  43 and Educational purposes. You have no ownership or proprietary rights
  44 in or to the Software. The Software, together with any archive copies
  45 thereof, shall be destroyed when no longer used in accordance with
  46 this Agreement.

  48 You agree to use your best efforts to see that any use of the Software
  49 licensed hereunder complies with the terms and conditions of this
  50 License Agreement as well as all laws and regulations of the United
  51 States and any other foreign country in which the Software is used.

  53 2. Permitted Uses.

  55 Except as prohibited below, you may make any modifications to the
  56 Software and recompile it for your own Private or Educational Use. You
  57 may make modifications to parts of the Distribution other than the
  58 Software only to the minimum extent necessary to allow your modified
  59 version(s) of the Software to operate. You shall not obtain any
  60 ownership, copyright, proprietary or other interest in or to the the
  61 Distribution, or any part thereof.

  63 3. Prohibited Uses.

  65 Commercial Use of the Distribution, or any part thereof, is
  66 prohibited. You may not modify the Software to communicate with other
  67 programs except for debugging or analysis purposes. You may not allow
  68 your modified version(s) of the Software to communicate with the
  69 unmodified Software. You may not disclose the Distribution, or any
  70 part thereof, to others in any form, original or modified. All other
  71 use of the Distribution, or any part thereof, not explicitly allowed
  72 above is prohibited.

  76 Joseph Humfrey shall retain unlimited transferable and commercially
  77 exploitable rights to the Distribution. Joseph Humfrey implicitly
  78 grants "idevgames.com" irrevocable perpetual non-exclusive
  79 distribution rights for the Distribution. Except as explicitly allowed
  80 hereabove, you may not reproduce, copy, or disclose to others, the
  81 Distribution or any part thereof.

  85 THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND,
  86 EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF
  87 MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT.
  88 IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY
  89 CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT,
  90 TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE
  91 SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.
